Apple's lawsuit against Psystar examined

July 16, 2008

Filed under:

So we just got our hands on the complaint Apple filed against Psystar for building off-label Mac clones, and as expected, Steve and friends aren't pulling any punches -- in addition to the eight total claims, request for a permanent injunction, and money damages, Apple wants a recall of every Psystar machine ever sold. That's harsh, but it's not like Apple to take this lightly. Like we've been saying all along, the suit is more about copyright infringement than EULA violations, since Psystar was distributing a modified version of Apple's copyrighted code outside the terms of the EULA. Grab the complaint here [PDF], and then head after the break for a quick breakdown of what Apple says Psystar is liable for.

PS. - Somewhat charmingly, we're quoted in the factual allegations section as calling the Psystar machine we reviewed "crazy loud" -- aww, you shouldn't have, guys. Maybe you want to throw in a citation next time, though? Just a thought.

Does Apple have an OS X update up its sleeve?

Mac OS X approaches 8% market share

Section: Apple, iPhone + Communications, iPhone, Mac + Computers, Software, Operating Systems, Leopard, Linux, OS-X, Tiger, Windows Net Applications, an online company that is geared towards finding the market shares of various companies, has found that Mac OS X is in second place for operating systems with a 7.94% share. Let’s just round and bring that up to 8%, alright? The only operating system beating Mac OS X is obviously Windows with a solid 90.89% share. In third comes your favorite open source operating system, Linux, with a .8% market share. However, the fourth place entry is sort of interesting; it’s the iPhone, not far behind Linux with a .16% share, and I’m sure the iPhone 3G will bring that number up. When you think about it, 8% is a huge number. With billions of computers worldwide, Mac OS X has made a significant dent in the operating system market, and I don’t see that stopping anytime soon. If Apple keeps innovating and keeps making their operating system more appealing to Windows users, they will surely surpass 10% in the near future.  With Snow Leopard around the corner, it will be interesting to see what happens.
